12 Jan. ’09 : Israel is using phosphorous illegally in Gaza Strip bombings

Information received by B’Tselem and several media reports indicate that the army is using phosphorous in the Gaza Strip. This weapon serves primarily to create screening, enabling forces to advance on the ground without being exposed. In addition, however, the phosphorous burns everything in comes in contact with, causing severe burns to humans. It is also capable of setting buildings and fields on fire.
International humanitarian law does not prohibit use of this weapon as such. However, the Third Protocol to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons which may be Deemed to be Excessively Injurious or to Have Indiscriminate Effects, which relates to incendiary weapons, states that such weapons may only be used against military objects. When the military object is located within a civilian area, the use of phosphorous is absolutely prohibited.

Israel has not signed the Protocol, but the rule it states is based on two customary principles of international law, which are binding on Israel. The first is the prohibition on using weapons that cannot distinguish between combatants and civilians, and the second is the prohibition on using weapons which by their nature cause unnecessary suffering. The use of such a weapon in a densely populated civilian area like the Gaza Strip breaches these two principles, and violates Israel’s obligation to take every possible precaution to limit harm to civilians.

B’Tselem demands that the army immediately cease using phosphorous in the Gaza Strip.

Vous avez le courage de reconnaitre les faits et c’est déjà pas si mal ; quand on lit ce thread... Toutefois, il est difficile de nier.
Pourtant, quand "Le péripate", ce clown triste, se permet d’en rire, que penser ? sinon que vous vous décrédibilisez avec ce genre de personnage, et que vous attisez la haine.
En fait, vous êtes très très inquiètant. Et pas que pour les juifs d’Israël. 

Les témoignages affluent, et nous ne sommes pas au bout de nos surprises.

Vous devriez réflêchir avant de diffuser ce genre d’article. Si ce n’est pour vous, faites-le pour les autres.

11 January 2009 : Attack on UNRWA school firing of indiscriminate weapon

On 6 January, the Israeli army fired a mortar shell at an UNRWA school in the Gaza Strip, which was serving as a shelter for civilians who had fled from their homes following air force bombings. According to various reports, more than thirty civilians were killed as a result of the shelling.

Today, 11 January, Ha’aretz reported that the army had conducted a preliminary inquiry into the incident. The report indicated that rocket fire from a building next to the school had been identified. For unclear reasons, firing from the air “was not possible” so the decision was made to direct fire “towards the source of the shooting.” The standard deviation of these mortar shells is a few dozen meters. Soldiers fired three shells, one of them hitting the school. Army officers told Ha’aretz that, in retrospect, “the choice of the means of response was faulty,” and that the army should have used a precise weapon. It was also reported that apparently, the school was marked on maps that had been given to paratroopers operating in the area.

B’Tselem demands that the lessons of the inquiry be implemented immediately. A standard deviation of a few dozen meters in the densely populated Gaza Strip is liable to result in dozens of civilian casualties. Under these circumstances, a weapon with this range of deviation constitutes a weapon that does not distinguish between civilian and military objects. Accordingly, it violates the principle of distinction in international humanitarian law and its use must be absolutely prohibited.
